Indirect discrimination

I was after some advice please . I have just gone foe a job within the company I work for and after the interview process I was successful and was offered the job . But I have had to turn it down as I would be loosing money due to not being able to work over time .
Now … when I bought up the money question I was given the reply that " I would need a 10% increase for the next 4 years to get me in the pay scale for the Tech leads job " so it was left that he was going to speak to HR to see what could be done .
I have since found out that the job was open to contractors and one also accepted the job . This was with-drawn as the company wanted a perm employee to do the job . So they said that they could not find anybody to do this job so it will be advertised external .
The then went straight back the contractor and asked him to do it and leave contracting and become a perm . Now the thing is I know how much money he has asked for and they have agreed to pay him .
I have been looking over and I think I could have a case for Indirect discrimination ? What do you think as they would not move on the money front for me but as the job has gone external they seem to do what they like and its discriminating against me as I am a perm employee.
I was accepted and passed the interviews for the job .. The person they have asked to join as for as I believe has not had a interview .
There was nothing in the job advert to say there was no pay rise and we don’t have a policy about Pay capping I have had a look on the company intranet and not found anything .
What do you think I should do ??
