Default Shouldn't my wife be protected under TUPE

My wife works for a company that entered compulsory liquidation. The company's assets and liabilities were assumed by another company and continued operations. She was retained by the new company, but they changed her contract. Is that legal? I thought that the TUPE protected her from any changes to her contract details in the event that her employment is transferred?

That is right, if the company taking over your wife's old company changes her employment terms and conditions then it is illegal! They also cannot terminate your wife for any reason that has something to do with the transfer.

I think that you wife is lucky she is being retained by the new company. Other employees in the same situation, like my Dad, are not as lucky. He was terminated from his job and it was very much legal.

I agree! Insolvency proceedings usually lifts the restrictions stipulated under TUPE.

In a compulsory liquidation, the courts decided that your wife's old company couldn't pay for its debts. As such, the employment is not automatically transferred to the new company. A compulsory liquidation ends all employment contracts as it becomes effective.

Different types of insolvency proceedings have different effects on how the old company's employees rights and responsibilities are affected. It's a case to case basis. Unfortunately, your wife's employment with any company (the original or the new one) in this case really did end on the date that the compulsory liquidation was ordered by the court, so legally, the new company can change her employment terms as they see fit.

Really? Then the TUPe doesn't really provide that much protection!
