Default Lesbian parenting

I have heard that a lesbian partner may also apply for paternity leave. My partner and I are having the baby next month, will I be eligible?

Hmmn, don't you have to be the biological father for this?

You might get some benefits if you adopt the child. You and your partner can adopt the child then you will be eligible for paternity leaves.

Doesn't that go against the point? Her partner is the biological partner, why do they have to adopt the child?

Hi LonzNoGenius:

I think you are entitled to paternity leave if you are the partner of the biological mother, it does not matter if you're male or female. Just as long as you have an enduring relationship with the mother. Lesbian and gay couples usually qualify under this.

You would need to sign a declaration that you intend to use the leave to care for your partner and her baby.

On top of that, you need to have at least half a year's service by the time your partner enters her 15th week before the delivery. For adoptees, it should be the 15th week before the adoption is supposed to take place.

That's true, but you have to be aware that paternity leaves are shorter, it only lasts for two weeks!

While your employer can give you a higher amount, it is required by law to be at a standard rate. The last time I checked, it was around £110.

Congratulations on the adoption

Yup LSullivan is right about that, you can qualify for paternity rights under the law. But it has more paperwork
