Default Seasonal Workers Arrangemenst

Need some help please....

We sell into schools and need some term time only office staff (40 weeks a year).

Should they be full time employees that receiver 12 weeks unpaid leave?

They will receive 18 days holiday + bank holidays for use during the 40 weeks.

We will also pay them 11 equal installments + commission.

(There's no work and no pay in August).

What's the best way for them as well as us to structure their employment?

It sounds like a toss up between a seasonal worker and an independent contractor. Let me caution you that an independent contractor is just that...someone that complete the work as often as they see fit and during what hours they want to. If you have a schedule and they are using company resources, this will not work. However, you could classify them as seasonal workers. Hopefully, they could draw unemployment during the off time. Essentially, you would "lay" them off. This sounds like a better plan to me, and this will be better for them so they can draw unemployment instead of having to take it unpaid.
