Default Help!

I have been offered a secondment to an office within the building i work in (it is with a different employer but we have close working relationships with the other company - wont go into too much detail though quite complicated!!). I always thought that secondments were for development reasons i.e. to get more experience to do the job properly. This one i've been offered is actually a step back if anything and i think i've only been offered it as a way of getting me out of the office as there is a restructuring of the current secretariat happening where i am. I was also told that they cant guarantee a job for me in my current office after the 6 months secondment is up, i thought they HAD to hold a job open (not necessarily the one you leave i understand that). Is this a legal way of "getting rid" of someone out of the structure - i'm guessing not!!!! I am not going to take the offer but i'm just wondering if i dont take it then i will have a big target on my back come the time the restructure is agreed!

Hi Wendy:

It is illegal for them to fire you while you are on secondment. If they do, you will still be entitled to a redundancy pay. Remember that your employer remains to be your current company, not the host company.

Yup, and if you reject the offer and find yourself being "the target" come restructuring time, then you can file for harassment.

Or it's a case of constructive dismissal if you resign.

I was about to say this. It seems like they are making your life a living hell, so even if you resign, you could still file a claim for constructive dismissal!
