Default Letter of complaint help

Hi Everyone
We wrote this letter and our Manager said that the lady in question could turn things around saying that we are trying to bully her. What do you think? any advice would be appreciated. Thank you

To the Attention of X HR Manager
RE: Letter of Complaint against Mary
Dear X
It is with a lot of reluctance and as a last resort that we are writing this letter to you. This letter is regarding a formal complaint against Mary, one of our staff members. Mary works as a Customer Service Assistant and has been an employee of this company for the past six years.

This letter has two purposes: first to formally submit a complaint, and secondly to put the facts of the situation on record. The subject of our complaint is Margaret’s general behavior and the ill treatment we received from her on many occasions. The latest one, on Wednesday 13th of July 2011, occurred in presence of our Catering Manager Y. On this one, we felt it went too far and we cannot let it go any longer.

We have every reason to believe that we are dedicated and good employees. We are confident that as colleagues we treat each other with respect. We tried to speak to her in Y presence thinking that it will make things easier but the outcome was negative and things have gone too far now.

The events were as follow:

• On Monday 11th of July 2011 in the afternoon at around 3pm Amy decided to clean the coffee machine. She got all the cleaning materials out ready to clean it. While Amy was busy setting up the counters for the next day, Mary asked her if she was going to clean the coffee machine. Amy positively answered: “Don’t worry I will do it”. 10 minutes later Mary started to clean the coffee machine which was fine for Amy who got on with other duties. So Mary started and finished cleaning it.

• On Tuesday 12th of July in the morning at around 11.30am, you, X came in the restaurant and in presence of Y, you asked MARY who was responsible for cleaning the coffee machine the day before. MARY replied: “B and Amy”. At that time Amy was not in the Restaurant but B was present and she talked to MaRY minutes later asking her why she told you (X) Amy and B cleaned the coffee machine when she clearly knew she did it the day before. MarY replied to B: “Sorry, I was confused”.

• On Wednesday 13th of July in the afternoon, at around 3pm, we had a staff meeting with our Catering Manager Y. We were sitting in the Restaurant. At the end of the meeting, Amy talked about the issue in a kindly manner explaining that she was upset about what happened asking MarY the reason she mentioned her and B names. MarY became very angry and started screaming so loudly that everyone could hear from distance. (Some people could witness). Y tried to calm her down to no avail. MarY kept on talking loudly and banging on the table then she stood up and said :

- She was confused that is the reason why she mentioned B and Amy’s names.

- That, on Tuesday, she apologized to B when B asked her why she mentioned her name and not to Amy because at that time, when X asked the question, Amy was cleaning the sitting area of the restaurant. Therefore there is no need to apologize to her, even though MaRY did not say the truth to X.
- There are no issues about it as long as B and Amy haven’t been disciplined for that.

- She got children and she does not have time to talk about this

After saying that, she walked away despite the fact that Yasked her to calm down and come back. She ignored her.

For us, there are few issues here to raise:

- We may accept MarY to report us to any manager or supervisor as long as the issue in question is true. However, we cannot accept MaRYto blame or report us for her own mistakes.

-As adults, we cannot accept to be screamed at especially if the person screaming is in fault.

We are sure that company policy must prohibit or discourage this kind of behavior. In fairness, we should point out that this is not the first time. However, despite our previous clear disapproval, she continues this unacceptable behavior. Even though S and N were not involved in this issue, they feel they have the right to be included in this letter of complaint. Each of us could give at least 3 examples in which MaRY has done something similar regardless of other unfair things she does on a daily basis.

At present, because of this behavior the team spirit is being seriously undermined. We find the situation at work very stressful. We feel we are loyal employees and work hard to get the job done in a professional manner. We do not need the added pressure of such discourteous and unnecessary treatment.

At the moment, we do not wish any disciplinary action against her. We trust you will agree, and we look forward to your assurance that it will not occur again as we don’t want to take any action further.
Amy and Grace would appreciate from Margaret the recognition of her errors and an apology.
We feel this is an entirely fair request.

I am confused, you refer to the lady in question as both Mary and Margaret. Is this just for privacy reasons you changed the names? Otherwise, the letter doesn't seem to appear as you bullying anybody - you are just looking for an apology and not disciplinary action.

Thank you very much for your message. Sorry, it was for privacy reasons. It is the same person.
Exactly, i just don't get why the manager said that.
