Default Employers' Duty of Care

I have often heard about this when bullying and harassment comes up in discussions. I'd like to know what it is and how it applies to bullying?

Simply put, it is your employer's responsibility to ensure your welfare and health. This has been mandated by the Health and Safety at Work Act that was passed in 1974.

Hmmmn, I can see how it relates to harassment and bullying. Since a lot of employees suffer undue stress from harassment and bullying, most of them fall sick or get depressed.

Not only that... your employer also needs to assess risks related to bullying and harassment and other types of issues at work. They are under duty to minimize these risk or remove it.

I think in this case, employers would benefit from making sure they do this duty. Bullying and harassment are very destructive and can lead to a loss of productivity among your workers.

This also means that your employer is required to act on any complaints regarding bullying and harassment, which makes it easier for you to complain if you have the right facts, witnesses and incidents!

Yup, although a lot of employers deny it, harassment can really get to you and cause you to be physically sick. But the more serious effect is the psychological damage it brings!
