Our workplace is currently clamping down on hiring Asians. It sounds horrible, but management says that two of our Asian colleagues didn't have immigration permits. Isn't that against the law that disallows discrimination???
Nope, not really. When you seek employment in the UK, you need to have the proper permits. In fact, not having work permits would easily disqualify you from the recruitment process.
Not only that, your company could face a lot of penalties for hiring workers with no work permits from immigration. If your company was caught to hire illegal workers, that could mean a criminal offence, often punishable by unlimited fines and even a prison sentence.
Hmmmn, are you guys sure that it's a criminal offence? From what I know, it's a civil offence to hire illegal workers... and that could easily give you a £10,000 fine for each worker you have.
Hmmmn, that seems to be a very strict fine for such an offence. Are there ways to still get migrant workers? For example our company is looking to absorb an outsourced team from India and require them to live in the UK, would we need to get their working permits for them???
Well, I think your company would have to sponsor them. Which means that you would need to register with the government first as a sponsor. Am not sure if you would be required to do anything else, but be sure to check with your lawyers first.
It seems to me that you can always claim that you do not know you hired illegal workers. The law does state that only those who "knowingly" hired these workers would be punished.
If they don't have working permits then I conclude that they are there in UK with visit visa only hence; they will be required to leave UK after a few months giving you too much headache after. Hence; do the right thing first, get them legal working permits in which case you need to file as their sponsors.
