Default change in contract hours

I have just heard this from a friend. His dad is 61, and the company he works for has reduced the number of hours that he works, because the manager said he looked tired. Is this age discrimination???

It could be if the change was made on the basis of his age alone. The manager or the employer has to prove that they didn't do it because of the dad's age.

Well, they could also reason out that it was because of the dad's health they took into consideration when they reduced his hours. But I don't think they would be able to pull it off, considering that they only gave looking tired as the reason. Yes, it could be a case of age discrimination.

What is more, I think they should be sued for breach of contract. It seems that the change in contract terms was done without his approval. The employee could even resign and claim constructive dismissal, which would equate more trouble for the company.

If you have a contract that is agreed-upon, it should state in the contract. Otherwise, no notice is required.

Did your friends father make any objections to this? If so it certainly seems unfair and could perhaps be discrimination. Does he want to take action on this/feel like he's been treated unfairly?

Well this is unfair decision for the dad of your friend. I think this is another discrimination.

We must always be sensitive with our action because we might know, we are already discriminating someone in some aspect that we are not aware.

May be 61 years of age it will be definetly lead to tired due to more than a five hours working.
